Rapture Terms of Service

By using Rapture ("the App"), you agree to these Terms of Service. Please read them carefully.

1. Service Description

Rapture is a hands-free voice recording app with optional transcription and Google Drive sync features. The App provides:

• Free Tier: Unlimited local voice recordings with voice-activated recording
• 30-Day Free Trial: Full access to premium features (transcription, Drive sync) with no credit card required
• Premium Subscription: $2.99/month or $24.99/year for real-time transcription and Google Drive sync

2. User Accounts

To access premium features and the 30-day trial, you must sign in with a Google account. You are responsible for:

• Maintaining the security of your Google account
• All activities that occur under your account
• Ensuring you have permission to use the Google account

3. Free Trial Terms

• One free trial per Google account and per device
• Trial duration: 30 days from first sign-in
• No credit card required
• Trial automatically expires after 30 days
• Premium features lock after trial expiration unless you subscribe

4. Subscription Terms

Premium subscriptions are billed through Google Play Store and are subject to Google's payment terms:

• Subscriptions auto-renew unless cancelled
• Cancel anytime through Google Play Store
• Refunds handled according to Google Play Store policy
• No refunds for partial months

5. Acceptable Use

You agree NOT to:

• Use the App for illegal purposes
• Record conversations without consent where required by law
• Attempt to circumvent trial limitations or subscription requirements
• Reverse engineer, decompile, or disassemble the App
• Use the App to harass, abuse, or harm others

6. Content Ownership

You retain all rights to your recordings and transcriptions. Rapture does not claim ownership of your content. Your recordings are stored in your personal Google Drive, which you control.

7. Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted access to the App
• Error-free operation
• Transcription accuracy (AI-generated transcriptions may contain errors)
• Successful Google Drive uploads in all network conditions

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENSOLUTIONS LLC SHALL NOT BE LIABLE FOR:

• Lost recordings or transcriptions
• Inaccurate transcriptions
• Service interruptions
• Data loss due to Google Drive quota limits
• Any indirect, incidental, or consequential damages

9. Third-Party Services

Rapture integrates with:

• Google Drive: Subject to Google's Terms of Service
• Google Cloud Speech-to-Text: Subject to Google Cloud's Terms
• Google Play Billing: Subject to Google Play's Terms

We are not responsible for the performance or policies of these third-party services.

10. Recording Laws

Important: Recording laws vary by jurisdiction. You are responsible for:

• Understanding local recording consent laws
• Obtaining necessary consent before recording conversations
• Compliance with wiretapping and eavesdropping laws

Rapture is designed for personal note-taking. We are not responsible for your use of recordings.

11. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of new Terms. We will notify users of material changes through the App or email.

12. Termination

We reserve the right to suspend or terminate your access to premium features if you violate these Terms. You may terminate your account by uninstalling the App and cancelling your subscription through Google Play Store.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
